Helplly — Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the Helplly website and mobile application (the “Platform”). By using the Platform, you fully agree to these Terms. If you do not agree with these Terms, please do not use the Platform.

1. General Provisions

1.1. Helplly is an online marketplace and mobile application platform that connects users with service providers.
1.2. Helplly does not directly provide services and acts solely as an intermediary facilitating communication between users and service providers.
1.3. These Terms apply to all individuals using the Platform, and all users are obliged to comply with them.
1.4. All features offered by Helplly — including booking, payments, messaging, and rating systems — are intended to facilitate connections between users and service providers and do not constitute any guarantee regarding service outcomes.
1.5. By using the Platform, users and service providers acknowledge that Helplly is only a technological intermediary and bears no direct responsibility for agreements or services performed between the parties.
1.6. Accessing the Helplly website or mobile application confirms that these Terms are legally binding and fully accepted by the user.

2. Definitions

2.1. “Platform” refers to the helplly.com website, iOS and Android mobile applications, and all digital service infrastructure managed by Helplly.
2.2. “User” means an individual who searches for, books, or uses services via the Platform.
2.3. “Service Provider” (“Provider”) means an independent individual or legal entity offering services through the Platform.
2.4. “Service” includes all activities and categories offered on the Platform, including but not limited to pet care and walking, child transportation, cleaning and household tasks, repairs and technical work, shopping, personal errands, and other services.
2.5. “Booking” means an agreement created via the Platform between a user and a service provider for service delivery and recorded within the system.
2.6. “Account” refers to the personal profile created by a user or service provider upon registration on the Platform.
2.7. “Payment System” refers to all payment and commission mechanisms conducted through the Platform.

3. Platform Role and Liability

3.1. Helplly acts solely as an intermediary and is not a party to service delivery.
3.2. Responsibility for service execution, quality, safety, and outcomes lies entirely with the service provider.
3.3. Helplly is not responsible for service provider conduct, accuracy, timeliness, or results.
3.4. Service providers are not employees, agents, or representatives of Helplly and operate independently.
3.5. Helplly bears no legal responsibility for disputes, misunderstandings, or breaches between users and service providers.
3.6. Helplly does not guarantee the accuracy of information, certifications, skills, or claims provided by service providers.
3.7. Helplly does not guarantee compliance of services with applicable laws and does not supervise service content or execution.

4. Mobile Application Usage

4.1. By downloading the mobile application or creating an account, you agree to these Terms.
4.2. Internet access is required to use the application.
4.3. Helplly reserves the right to modify, restrict, or update application functionality.
4.4. All data entered through the application is the user’s responsibility.
4.5. Helplly is not responsible for technical issues, interruptions, or failures caused by third-party systems (e.g., payment providers).
4.6. Ensuring device security is the user’s responsibility, and Helplly is not liable for unauthorized access.

5. Account Creation and Security

5.1. Minimum age requirement is 18 years.
5.2. Users must provide accurate and complete information during registration.
5.3. Account security is the user’s responsibility.
5.4. Using another person’s account or transferring an account is prohibited.
5.5. Users are responsible for all actions performed through their account.
5.6. Any changes or suspicious activity must be reported immediately to Helplly.
5.7. Helplly may restrict or suspend accounts in cases of suspicious activity or Terms violations.

6. Booking, Payments, and Commission

6.1. All bookings are made through the Platform.
6.2. Service prices are set by service providers.
6.3. Payments are processed using methods determined by Helplly.
6.4. Helplly may charge commission or service fees.
6.5. Refunds are governed by Helplly’s Refund Policy.
6.6. Prices displayed are informational and subject to change.
6.7. Unconfirmed or failed payments invalidate bookings.
6.8. Users are fully responsible for the legality and accuracy of payment details.

7. Service Provider Obligations

7.1. Service providers must provide accurate and up-to-date service information.
7.2. Services must be delivered on time and in good faith.
7.3. Required licenses and permits must be obtained.
7.4. No harm may be caused to users, property, pets, or children.
7.5. Ethical and safe conduct is mandatory.
7.6. Platform use must be lawful and personal.
7.7. Service providers are fully responsible for tools and equipment used.
7.8. User personal data must be used solely for service execution and kept confidential.

8. Cancellation Policy

8.1. Users may cancel bookings within the specified timeframe.
8.2. Service providers must notify users of cancellations in advance.
8.3. Helplly provides technical support only and bears no financial liability.
8.4. Excessive cancellations may result in account restrictions.
8.5. Alternative providers may be suggested without obligation.
8.6. Cancellation fees and refunds follow the Refund Policy and provider rules.

9. Code of Conduct

9.1. Mutual respect and ethical behavior are required.
9.2. Prohibited actions include abuse, threats, violence, fraud, illegal activities, misuse of personal data, and payment evasion.
9.3. Violations may lead to account suspension or deletion.
9.4. Providing misleading or false information is considered a serious violation.
9.5. Safety threats must be reported to Helplly.

10. Limitation of Liability

10.1. Helplly bears no responsibility for service quality or results.
10.2. Helplly is not liable for damages to persons, property, pets, or children.
10.3. Helplly is not responsible for delays or misunderstandings.
10.4. Helplly is not liable for direct or indirect financial losses.
10.5. Use of the Platform constitutes acceptance of these limitations.
10.6. No guarantee of uninterrupted or error-free operation is provided.
10.7. Helplly is not responsible for inaccurate provider information.

11. Personal Data Protection

11.1. Personal data is processed according to the Privacy Policy.
11.2. Providers may access only necessary user data.
11.3. Data is not shared with third parties unless required by law.
11.4. Technical device data may be collected automatically.
11.5. Users consent to data processing by using the Platform.
11.6. Providers must not store or misuse user data.

12. Notifications

12.1. Notifications may be sent via email, SMS, or in-app alerts.
12.2. Disabling notifications may affect functionality.
12.3. Essential notifications may not be disabled.
12.4. Users are responsible for accurate contact details.

13. Account Restriction and Termination

13.1. Helplly may restrict or delete accounts for violations or risks.
13.2. Access may be limited at any time without explanation.
13.3. Account deletion does not remove prior liabilities.
13.4. Accounts may be blocked immediately for fraud or illegal activity.
13.5. Data retention is not guaranteed after account termination.

14. Amendments

14.1. Helplly may update these Terms at any time.
14.2. Updated Terms take effect upon publication.
14.3. Continued use constitutes acceptance.
14.4. Users may be notified via platform or email.
14.5. Changes do not apply retroactively unless stated otherwise.
